This comparison is not intended to argue that one approach is superior in all situations. It is intended to show where the differences lie, so the choice can be made on accurate terms.

Costs accumulate as work proceeds. The final amount may be significantly higher than the initial estimate.

Small ancillary questions — those that arise naturally in the course of a matter — may be deferred to avoid additional charges.
The matter closes. The client has a document or a letter. Whether they understand the full implications is not always confirmed.

Written advice is clear. Where a legal term is necessary, its ordinary meaning is included immediately below.
Questions within scope are addressed as they arise. There is no financial reason to defer them.

Understanding the investment in perspective
The cost of a legal matter is not only the professional fee. It includes the time spent managing uncertainty, the cost of decisions made without adequate advice, and — in some cases — the cost of later remediation.
A fixed fee, agreed before work begins, changes the calculation. The question shifts from "what will this end up costing?" to "is this the right use of that known amount?" That is a more productive question to work from.

"Fixed scope means limited advice."
Scope is defined to match the matter — not to limit what can be said within it. Questions within scope are answered fully, and the scope can be extended by agreement if a matter develops beyond its original terms.

The legal analysis is the same. The output is translated. Writing clearly about a complex point is more demanding than writing technically about it — it requires both the legal knowledge and the skill to render it accurately in ordinary terms.

Fixed scope works where the matter can be defined clearly at the outset — which includes partnership agreements, boundary disputes, and retainer arrangements. It is not suited to matters where the scope cannot be determined in advance, and we say so where that applies.
